Terms
The following conditions apply when purchases are made from Propsurv Ltd trading as Next Day Hips, including purchases made via the telephone or from this website. The contract is between Propsurv Ltd trading as Next Day Hips (1) the Seller and the person names on the credit/debit card, the cheque or the property owner paying cash (2) the Purchaser. The contract commences once an instruction for a Home Information Pack or Energy Performance Certificate has been received and accepted by online transaction by telephone or by email.
Jurisdiction
This contract shall be governed by English Law and under the jurisdiction of the English Courts only.
Delivery Times
Delivery time and dates quoted by Propsurv Ltd. trading as Next Day Hips are for guidance only and are not binding in any way. Propsurv Ltd trading as Next Day Hips Ltd. will not accept any liability for any loss due to delay of the delivery date.
Force Majeure
Propsurv Ltd. trading as Next Day Hips will not accept any liability for any delay or failure to perform its duties due to any forces outside of its control such as but not limited to Acts of God, Acts of terrorism, flood, fire, explosion, malicious damage and any other circumstances beyond the companies control.
Refund Policy
Our service begins immediately once you have placed an order. Once you have placed the order we subsequently place orders with our suppliers and enter into legally binding agreements with commercial entities and with Government bodies, as a result, the Purchaser acknowledges that any refunds are at the sole discretion of Propsurv Ltd. trading as Next Day Hips. The Purchaser undertakes to ensure that the decision to purchase a Home Information Pack or Energy Performance Certificate is a considered decision and the Purchaser recognises that no automatic right of refund exists. Propsurv trading as Next Day Hips reserve the right to offer a refund at its sole discretion.
Your Statutory Rights are not affected.
Appointments
The Purchaser agrees to give a minimum of 24 hours notice of cancellation should they need to cancel the appointment made for the Domestic Energy Assessment for the purpose of producing the Energy Performance Certificate, should the Purchaser not give the required notice and the Domestic Energy Assessor has to revisit the property then a charge of £25.00 will made for this.
Accuracy of Information
The Purchaser undertakes to ensure that all details provided when purchasing the Home Information Pack or Energy Performance Certificate are correct and accurate. The Purchaser accepts full responsibility for any inaccurate information provided and undertakes to pay any resulting costs due to inaccurate information provided.
Liability
Propsurv Ltd. trading as Next Day Hips will in no event be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from but not limited to loss of data or profits arising out of or in connection with the use of this service. Our maximum liability under this agreement for all losses, damages and costs is limited to the amount paid by the Purchaser for the service used.
Jurisdiction
This contract shall be governed by English Law under the exclusive jurisdiction of the English Courts.
Complaints
If you wish to make a complaint we will endeavour to deal with it as speedily and quickly as possible.
Your complaint will be dealt with as follows:-
The complaint will usually be acknowledged within 5 working days of receipt;
We will normally deal with complaints fully within 4 weeks of receipt;
We will keep you informed by letter, telephone or email, as you prefer, if we need more time;
We will provide a "final response", in writing within 8 weeks;
We will liaise, at your request, with anyone acting on your behalf.
